By accessing or using the services provided by Pagencio at www.pagencio.com ('Service'), you agree to be bound by these Terms of Service ('Terms'). If you disagree with any part of the terms, then you may not access the Service.

2. Description of Service

Pagencio provides a 'Website-as-a-Service', which includes the design, development, hosting, and maintenance of websites for clients based on a subscription model.

3. User Accounts

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree to notify us immediately of any unauthorized use of your account.

4. User Conduct

You agree not to use the Service to:

• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, or otherwise objectionable.
• Infringe upon the intellectual property rights of others.
• Engage in any activity that interferes with or disrupts the Service.
• Attempt to gain unauthorized access to any part of the Service.

5. Fees and Payment

You agree to pay all applicable fees for the Service as described on our pricing page. All fees are non-refundable except as required by law. We reserve the right to change our prices at any time.

6. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. You may cancel your subscription as per the cancellation policy available in your dashboard.

7. Intellectual Property

The Service and its original content (excluding content provided by you), features, and functionality are and will remain the exclusive property of Pagencio and its licensors. You retain all rights to the content you provide for your website; however, the underlying design and the code remain the property of Pagencio unless otherwise agreed upon in an Enterprise plan.

8. Disclaimer of Warranties

The Service is provided on an 'AS IS' and 'AS AVAILABLE' basis. Your use of the Service is at your sole risk. The Service is provided without warranties of any kind, whether express or implied.

9. Limitation of Liability

In no event shall Pagencio, nor its owner, employees, partners, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any new terms taking effect.
